Montezuma County, Colorado occupies the southwestern corner of the state, with Cortez as the county seat. The county's trial court operates through the 22nd Judicial District under a Combined Courts structure, handling criminal, civil, domestic relations, probate, juvenile, and traffic matters in one location. Records from these proceedings — dockets, pleadings, motions, orders, and judgments — are preserved in both paper and electronic formats under Colorado Rules of Civil Procedure Rule 79 and related court directives.

Court records serve a real public function. They document legal proceedings, support appeals, verify judgments, and create a transparent record of judicial activity. Knowing where those records are held and how to request them can save you considerable time, whether you're conducting a background search, managing an estate, or reviewing a prior civil judgment.

Are Court Records Public in Montezuma County?

Colorado maintains a strong presumption of public access to court records. Colorado Revised Statutes § 13-1-119 and Chief Justice Directive 05-01 together establish that most court documents — dockets, filings, hearing records, and judgments — are available for public inspection during regular business hours.

Records That Are Generally Public:

  • Civil and criminal case dockets and final judgments
  • Probate filings including wills, estate inventories, and conservatorship orders
  • Domestic relations orders (though certain exhibits may be restricted)
  • Traffic and infraction records
  • Most County Court and District Court filings

Records That Are Restricted or Confidential:

  • Juvenile court proceedings and records
  • Mental health and alcohol commitment proceedings (no filing fees charged, and records are protected)
  • Adoption files
  • Records sealed by court order under C.R.S. § 24-72-704
  • Certain criminal history details regulated by the Colorado Criminal Justice Records Act (CCJRA), § 24-72-301 et seq.

The Colorado Open Records Act (CORA) governs access to administrative records held by government agencies, while the CCJRA specifically controls criminal justice records maintained by law enforcement. Both laws allow the custodian to deny access when disclosure would be illegal or contrary to the public interest.

Court-level criminal records show individual case outcomes but are not a substitute for a comprehensive criminal history. Under the CCJRA, access to complete criminal histories is restricted, and certain records require court authorization or fingerprint-based checks for full disclosure.
