Are Court Records Public in Eagle County?

Payment can be made in person by cash, check, money order, or credit card. Checks should be payable to the Eagle County Sheriff’s Office. Walk-in requests at the Eagle office are typically processed while you wait, though requests requiring off-site retrieval or extensive research may take up to 72 hours, consistent with Colorado statute.
Note that the Sheriff’s Office will not release reports to anyone listed as a defendant in an active or open case. Defendants may be able to obtain copies through the District Attorney’s Office at (970) 328-6947.

Sealing Criminal Records
Petitions to seal criminal records in Eagle County are filed in District Court. The filing fee for a petition to seal a criminal conviction is $65 (C.R.S. § 24-72-706). Petitions to seal non-conviction records carry no filing fee (C.R.S. § 24-72-705). A petition to seal records at the district level costs $224 (C.R.S. § 24-72-704).
Eagle County Civil Court Records
Civil disputes in Eagle County are heard by either the District Court or the County Court, depending on the amount in controversy. Under current Colorado law, the County Court handles civil claims up to $25,000, including small claims (up to $7,500), landlord-tenant disputes, and forcible entry and detainer actions. The District Court has jurisdiction over civil matters exceeding $25,000, as well as appeals from County Court decisions.

Eagle County Family Court Records
Family law matters in Eagle County are handled by the District Court, which has jurisdiction over divorce and legal separation, child custody (allocation of parental responsibilities), child support, paternity, adoption, and domestic violence protection orders.
Divorce and Legal Separation
Colorado refers to divorce as “dissolution of marriage”. Petitions for divorce, legal separation, or annulment are filed in the Eagle County District Court. The filing fee for a petition is $260, and the response fee is $146. A motion to modify a decree or final order filed more than 60 days after the original order costs $105. Child Custody and Support
Custody petitions (Allocation of Parental Responsibilities) carry a $252 filing fee. Parentage actions — which may establish child support obligations — have a $268 filing fee when filed in juvenile court. Motions to modify a parentage order supported by DNA results cost $70.

Domestic Violence Protection Orders
Petitions for civil protection orders under C.R.S. § 13-14-109 are filed in County Court with a filing fee of $95. Protection order forms and form packets are provided at no charge.
Confidentiality of Family Records
Adoption records, paternity records, and certain juvenile proceedings are confidential under Colorado law. Sealed records are not available for public inspection. Birth and death certificates are maintained by the Eagle County Public Health and Environment Department and are generally confidential under C.R.S. § 25-2-117, available only to individuals with a direct and tangible interest.
