Are Court Records Public in Douglas County?
Douglas County court records are presumed open to the public. The Colorado Open Records Act (CORA), C.R.S. § 24-72-203, requires government agencies to make records available for inspection at reasonable times. For court-specific records, Chief Justice Directive 05-01 and the Public Access to Information and Records Rule (P.A.I.R.R.) establish the framework for how court files are accessed, copied, and restricted.

Records excluded from public access include:
- Juvenile case records, governed by the Children’s Code, C.R.S. § 19-1-301 et seq.
- Sealed or expunged records — Petitions to seal conviction records are filed under C.R.S. § 24-72-704; non-conviction records under § 24-72-705 (no fee for non-conviction sealing)
- Confidential personal data such as Social Security numbers, financial account information, and medical records contained within court files
- Adoption records
- Mental health proceedings (no filing fee charged)
- Records shielded by attorney-client privilege
- Trade secrets and proprietary information
- Records where disclosure could compromise an ongoing investigation or national/state security
The Colorado Criminal Justice Records Act (CCJRA), C.R.S. § 24-72-301 et seq., provides separate rules for law enforcement records. Under § 24-72-305, a custodian may deny inspection if prohibited by law, Supreme Court rule, or court order, or if release would be contrary to the public interest.

Criminal cases in Douglas County are divided between the District Court and County Court based on the severity of the offense. The District Court handles all felony prosecutions, sentencing hearings, and appeals from lower courts. The District Attorney’s Office handles records requests under the CCJRA and CORA through its own online portal; it does not accept requests by email or phone.
Douglas County Civil Court Records
Civil disputes in Douglas County are heard in either the District Court or County Court depending on the amount at issue. Civil case records are maintained by the Clerk’s Office at the Douglas County Courthouse. Accessing family court records:
Due to the confidential nature of many family law matters, adoption records, juvenile cases, and dependency and neglect files are restricted. Non-parties generally need a court order for access. Dissolution of marriage records that do not contain financial agreements or parenting plans are typically public. To request family case documents, use the online records request form or email DouglasRecords@judicial.state.co.us.
Marriage licenses are issued by the Douglas County Clerk & Recorder Recording Office at 301 Wilcox Street, Castle Rock, CO 80104. Both applicants must appear in person by appointment (schedulable online after completing the online application). The license fee is $30, payable by cash or credit card. The license must be used within 35 days and the signed document returned for recording within 63 days of the ceremony; late returns incur fees of $20 up to $50. Certified copies of a recorded marriage license are $1.25 each. Marriage license applications are confidential under Colorado law; only parties to the marriage or immediate family with photo ID and proof of relationship may request copies using the copy request form.
Divorce records are maintained by the District Court and can be searched through the clerk’s office or the LandmarkWeb portal. The Colorado State Archives holds divorce indexes from 1904 to 1992. Fees are $25 for the first certified copy and $20 for each additional copy of the same certificate ordered at the same time. Expedited two-day USPS shipping is available for an additional $20 on mail/fax orders. A 2.5% convenience fee (minimum $2.00) applies to credit and debit card payments.
